CARI learned that FERC denied the several requests for rehearing on its congestion corridor licensing rule.  CARI was one of about 8 parties seeking clarification or rehearing of the rule.

CARI's Motion to Intervene in the federal litigation brought by NYRI to challenge the 2006 amendments to the State Transportation Corporations Law.  Those amendments limited the availability of state eminent domain authority.  NYRI has argued the amendments are unconstitutional and, in the alternative, do not apply to NYRI. Our papers argue that NYRI is not an electric corporation entitled to
eminent domain authority under any circumstance, or if it is, the 2006
amendments apply to deny that power.
